Hotline Tip: Will My E&O Policy Protect Me From Future Litigation?

NNA Hotline Tips For NotariesI have a question regarding my Errors & Omissions coverage. Will I still be covered years after my current policy ends, if I happen to be called into court in the future for a notarization I performed years ago?

Yes, with NNA policies, you will be. The E&O policy covers notarial acts occurring any time during the policy term, and even when a lawsuit is filed well after the policy term expires, subject to the state’s applicable statute of limitations. As long as you had a valid Notary commission at the time and did not intentionally break the law when you notarized, you should be covered. The NNA recommends asking your policy provider to make certain. If you do not have an NNA policy, read the policy language carefully or speak with your insurance agent.
