Hotline Tip: Can I Accept An Immigrant's License As ID?

NNA Hotline Tips For NotariesIs a California driver’s license issued to an undocumented immigrant acceptable as valid proof of ID for notarization? –W.V.K., Laguna Niguel, CA

California recently passed a new law that allows the Department of Motor Vehicles to issue drivers’ licenses to certain undocumented immigrants eligible for work permits, but not able to obtain a Social Security number. The state considers these drivers’ licenses as a valid form of identification, and they can be accepted as such by California Notaries. To be issued a license, the undocumented immigrants must provide satisfactory proof that they meet all requirements of the new law as well as California DMV regulations.

California is the first state to grant drivers' licenses to undocumented workers who have been identified under the “Dream Act’s” federal policy considerations.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. –The Editors
