Can I accept a copy of a driver's license stored on the signer's phone as proof of signer identity? — I. R., New Jersey
No. But there is a bill in the New Jersey Legislature that would, if enacted, authorize the use of “mobile driver’s licenses” (mDL). Until legislation authorizes mDLs and mDLs are approved by the New Jersey State Treasurer to be used by Notaries, New Jersey statute requires the actual ID (driver’s license, passport, or government-issued nondriver ID, etc.) to be presented to a Notary (NJSA 52:7-10.8.f[2]).
