Do I need to record weddings I perform in my Notary journal?

I am offering wedding officiant services as part of my Notary business. I just wanted to check: when signing the marriage license, does that also get recorded in my Notary journal? — B.S., Tennessee

Yes, if you charge a fee for your wedding officiant services. A Tennessee Notary is required to record all notarial acts, including solemnizing a marriage, in a journal if the Notary or Notary’s employer demands and receives a fee (TCA 8-21-1201[b]).

Not all states authorize Notaries to officiate weddings. For a list of states where Notaries can solemnize marriages and more information, please see our article on Notaries performing weddings.

Hotline answers are based on the laws in the state where the question originated and may not reflect the laws of other states. If in doubt, always refer to your own state statutes. – The Editors
