Handling Requests To Notarize Out-Of-State Documents

Notaries know they are only authorized to notarize within the jurisdiction defined by your state, which in most cases is your state. But what do you do if a signer needs to have an out-of-state document notarized? Are you authorized to do so, and, if so, how?  

The Easy Answer: Yes, You May Notarize Out-Of-State Documents

You are allowed to notarize documents that are sent and /or recorded across state borders — provided, of course, that you are notarizing the document within the boundaries of your jurisdiction.

It doesn’t matter where the documents will be recorded as long as you are following the Notary laws for your state. This includes documents for out-of-state real estate transactions, such as purchases or mortgage refinances.

Note, however, that Notaries in Kentucky with a Special Commission may only notarize documents that will be recorded in Kentucky.

Check — And Correct — The ‘Venue’

Be sure the “venue” portion of the notarial certificate reflects the state and county where the notarization actually takes place; if that portion of the certificate is pre-populated with another venue, cross through it and enter the correct information.
 

Know — And Follow — All Your State’s Notary Laws

Even when notarizing an out-of-state document, which may have certificates specific to the state where it is being filed, you are still responsible for knowing and following your own jurisdiction’s laws.

For example, in California, as of January 1, 2013, any document that affects real property requires the Notary to obtain the thumbprint of all signers in your Notary journal. You will need to record the signers’ right thumbprint for every document you are notarizing within the refinance package, since the mortgage, deed of trust or any affidavits in the package affect real property. This law applies regardless of where the property is located.

Remember: When dealing with out-of-state documents, the Notary laws of your jurisdiction always supersede those of the state in which the document will be recorded.

Hello. A person who has an office or place of business in New York state may hold a New York Notary commission. A Notary resident of New York State who moves out of state but still maintains a place of business in the state may remain a Notary; otherwise, the office of Notary is thereby vacated (EL 130). “All notaries public who wish to perform notarial acts in New York State, must: … within five days after a change of name, address, or e-mail address, transmit to the secretary of state a notice of the change, signed with the notary public’s official signature” (19 NYCRR 182.3[a][8]). This requirement applies equally to Electronic Notaries (19 NYCRR 182.4[a]).

I am in New York. If I notarize a document intended to be filed in another state, while I am physically in New York, isn’t there some sort of an ‘affidavit of conformity’ that also has to be included? I have personally never done one, but I have seen documents notarized in other states that also included this affidavit of conformity indicating that although it was notarized out of state somehow it is acceptable in New York. Once the signer has selected the type of notarization, you would need to complete the appropriate notarial certificate wording. Hello. If you meet the requirements for a CA Notary commission, you may perform traditional pen-and-paper notarizations for signers within the borders of California. However, California's remote notarization law is not expected to take effect until 2030 or later, so you cannot perform remote notarizations as a CA Notary at present. My question is the following: very often my clients have indicated their own State on the form they are looking to be notarized. While online with signers, I can not remove or cross their State to indicate Nevada and county as the venue. What should I do? Can I still notarize the documents with another State and county than mine or not?

The state and county above the Notarial verbiage, referred to as the “venue”, should indicate the state and county the Notary is located in at the time of notarization. If the document has the wrong venue, you cannot correct it, but you can use a Notary attachment where you can enter the correct venue.

A California document needs to be signed in counterpart by two parties on the same day: one signer will be in California and the other signer will be in Washington, DC. The document doesn't relate to real estate. May the notary in DC complete the California jurat, provided the venue information is correct? Must the notary in DC complete the California jurat? If you are authorized to perform remote notarizations, you may perform a remote notarization for an out-of-state signer provided you are physically located in Florida during the remote notarization. Otherwise, the signer would have to appear in person before you within Florida's borders in order for you to perform a notarization.

Hello. Texas Notaries only have authority to perform notarizations while physically located within the borders of Texas (GC 406.003). You could notarize a document from Colorado if the signer personally appeared before you in Texas with the document to have it notarized. However, you could not physically travel to Colorado to perform notarizations there.

I'm a TX notary. Have 2-3 questions. I've been asked to notarize a GA Limited Warranty Deed, the notarial language on this document is different from what I typically see in TX or from most states and it doesn't ask the date of notarization (10.27.2023). However the proceeding statement before the notary section the document refers to the indenture date and that date is a future date (11.3.2023). Example: "...Grantor has executed this instrument under seal, as of the date first above written." Q1. Would notarizing this document conflict with my TX notary statues. Q2. Does TX require all notarizations to contain the date of notarization? I have not been able to determine whether the date of notarization is required by TX.

Hello. In Washington, “(a) A notarial officer may not perform a notarial act with respect to a record to which the officer or the officer’s spouse or domestic partner is a party, or in which any of the above have a direct beneficial interest. “(b) A notarial officer may not notarize the notarial officer’s own signature. “(c) A notarial act performed in violation of this subsection (2) is voidable” (RCW 42.45.020[2]). “While not expressly prohibited by chapter 42.45 RCW, it is also generally inadvisable for a notary to notarize a document for extended family members. A notary that performs a notarial act for a family member may be seen as having a conflict of interest in the transaction, which could call the notarial act into question” (Notary Public Guide). Regarding foreign-language documents, “A notary is generally not responsible for confirming the contents of a document (outside of certifying a copy, but that has unique standards), however, they do need to make sure the correct notarial certificate is on the document. As of July 1, 2018, all notarial certificates must either be in English, or in dual-languages where one of the languages is English, so the notary should be able to identify the certificate on a document being notarized” (Notary Public Guide).

My wife lives in Arizona. She needs to sign and have notarized, a waiver which is a document generated by the California divorce court. It has wording on the notary page which says “State of California, city of Riverside” and “I certify under penalty of perjury under the laws of the state of California that the foregoing paragraph is true and correct..” Can this waiver be notarized in Arizona?

Hello. It would not be possible to use the venue information as described because the notarization is taking place in Arizona, not in California. It may be necessary to contact the agency that will receive the document to request instructions if the notarization must be performed in a different state.

When dealing with out of state documents a lot of them have "notary affidavit". It has a section with notary information then a statement that says that the signer provided me with the proper identification etc then it required my signature & date. To my understanding we can't do those in the state of California. My customer had a hard time understanding why. Is there anything you can provide me with to be able to show them. Please help! A Notary Public cannot complete this document because the request is not an official notarial act. As Notaries Public, we only notarize people’s signatures. The Notary affidavit is not a document that can be completed in your official capacity as a Notary Public.

A couple came to me to have the deed of their timeshare notarized because they are selling it. The notarial wording was that of an acknowledgement but they said their attorney told them it had to be signed in the presence of a notary. I did the notarization as an oath/jurat and added "sworn to" into the notarial certificate. Was this ok to do or should I just have done it as an acknowledgement?

If you are trying to file paperwork to run for US House of Representatives, and get your paperwork notarized with two witnesses, does your paperwork have to be notarized at the State House in Kentucky, or can it be notarized with two witnesses that live in the county your representing, that vote there at a bank notary? I was told by someone that it has to be notarized at the State House only, not at another notary.

Hello. In order to perform remote notarizations as an Ohio Notary, you must complete a two-hour training course, pass an exam and contract with a RON technology provider that meets state requirements. Ohio remote Notaries may perform remote notarizations for signers in any location, but the Notary must be physically located in Ohio when the remote notarization is performed. Hello. If you hold a Michigan Notary commission, you cannot use it to notarize documents while located in Ohio. The only out-of-state applicants who are eligible to apply for an Ohio Notary commission are attorneys admitted to practice law in Ohio who have a principal place of business or law practice within the state (ORC 147.01[B]).

I purchased an old vehicle from Tennesse. The title is dated 1977. It required to be notarized back then. Tennessee no longer requires titles to be notarized upon selling. Seller signed and I signed title in 2021. So now I’m home in Colorado trying to get it titled in my name but Colorado dmv says title needs notarized. I contacted TN DMV they said no longer doing notary. Shouldn’t Colorado except that Tennessee doesn’t notarize titles. This is a nightmare for me.see the old title has a spot for an notary and Colorado is saying because that’s there title must be notarized or stamped. Getting seller and myself in one place is almost impossible. What should I do?

Hello My family is asking me to notarize a POA that is in Spanish and is for use in a Mexican real estate transaction. My questions are a) does my notary seal have to be in English (the subscribed and sworn to me.. language)? The whole thing is in Spanish, which i mostly understand. b) I am in Illinois and this document does not transfer title itself, but if for a real estate transaction in Mexico. Do i need to obtain thumbprint? C) the form says, “..in my office at the address of…” and my relatives are asking for my work office address, but it will NOT be performed there. Is this something (if they can’t change the wording) I should discuss with the attorney I work for? Thank you.

Hello. There are different options depending on what state you and the signer are located in. If the signed document can be sent to the signer, the signer could go to a Notary in their state and request a notarization. If your state authorizes remote online notarizations (RON), it may be possible to have the signature notarized using RON. However, we would need more information on what states are involved and where the notarization would take place in order to provide you with more state-specific information. .

A MD Notary authorized to perform remote online notarizations may perform a notarial act for a remotely located individual located outside of Maryland, but the Notary must be physically located within Maryland's borders at the time the remote notarization is performed.

I am in the State of Michigan and have a document with a signature of a person in New York County, State of New York that was notarized by a notary of the public of the State of New York. Two counties in the State of Michigan will not accept the document because the notary does not have the clause "acting in the county of New York" in the notarial certificate. Michigan requires its notaries have this statement on notarial certificates and is usually included on the notary's stamp. This really is redundant because the venue is noted at the top, in this case “State of New York, County of New York: ss." Can Michigan legally reject the notarization as invalid because it doesn't have the wording "acting in the county of New York" when it's an out of state notarization? York) ss.:”

Unfortunately, this does not address my question. A freelance notary and an employed notary are two different things. Also, a notary hired by a notary services company working for a title company who is working for a lender is not the same as being employed by a lender or attorney. This is my concern, that a strict reading of the law excludes that situation. What I need to know is if the law applies to real estate transactions in Mass. or nationwide. Nobody seems to be able to answer that question. :(

Mass does not allow solo notaries to notarize real estate closing/refi documents unless they work or an attorney or the lender. Do you know if this includes out-of-state transactions?

I am recording a deed in Massachusetts. The Grantor is in Connecticut and the acknowledgment is by an attorney in Connecticut who is a "Commissioner of the Superior Court" in Connecticut and as such may acknowledge deeds. His stamp says "Commissioner." The registry, relying on Mass indexing standard 4-4 which in turn relies on MGL 183, section 30 is asking for a Certificate of Good Standing from Connecticut to attach to the deed. Commissioners do not need such a COGS in CT and their commissions do not expire. Can Massachusetts require more than CT requires for a CT acknowledgement on a Massachusetts deed. In all other respects the acknowledgment is satisfactory. Thank you.

Hello. The state of Georgia has traditionally been an “attorney-closing state,” meaning that only licensed attorneys may conduct the settlement at which closing documents are signed. Indeed, in an opinion released November 10, 2003, the Georgia Supreme Court issued UPL Advisory Opinion 2003-2 and thereby dictated that only licensed attorneys — and not laymen such as Notary Signing Agents — may handle closings of home loans and other real estate transactions. “(W)e have consistently held that it is the unauthorized practice of law for someone other than a duly-licensed Georgia attorney to close a real estate transaction or to prepare or facilitate the execution of such deed(s) for the benefit of a seller, borrower, or lender,” the opinion stated. The Georgia Supreme Court’s endorsement of UPL Advisory Opinion 2003-2 did not prevent certain Georgia attorneys who were not the attorneys of record for a given real estate transaction from doing what Notary Signing Agents do when they conduct witness only closings — i.e., attend only the appointment at which loan and real estate conveyance documents are signed. While the companies dispatching these attorneys argued that they thereby met the legal requirement of having an attorney present for the closing, real estate attorneys across the state contended it was the law of Georgia that a single “settlement agent” must handle all parts of a real estate transaction — from abstracting the title and rendering a title opinion to overseeing the signing of documents and disbursing of funds. As a result of this dispute, effective July 1, 2012, Georgia Senate Bill 365 was signed into law as Act No. 744 to clarify that only a lender or a licensed Georgia attorney may conduct settlements and disburse closing funds in the state; and the law further prohibits anyone other than the settlement agent for the entire transaction from overseeing the closing session (OCGA 44-14-13[10]). “Any individual, corporation, partnership, or other entity conducting the settlement and disbursement of loan funds, when he, she, or it is not the settlement agent, shall be guilty of a misdemeanor” (OCGA 44-14-13[10][f]).

What do I say to the person who will not accept the scratched-out and corrected information regarding the state and local jurisdiction? The pre-printed affidavit had Texas and Dallas, it was crossed out and replaced with the proper state and city of jurisdiction. The person in Dallas refused to accept this. Are there words I can use to help them understand that is SOP? Thank you.

My car is titled in California however I moved to Texas and registered my car in 2017. I was told to avoid having to fly out to California to request my title I can also give my father a Notarize consent letter authorizing him to request my car title. Is this possible?

I just had a notary in Wi. stamp a POA for me in AZ. They called me to say not valid because in AZ they need the notary stamp to have the exp. date on the stamp. I've called different banks who tell me the Wi stamps don't have that, the exp. date is separate on the form. Is AZ right? If so then it can't be done in WI.

I am a notary in New Jersey. We work with attorneys in New York who often need legal documents notarized with our company's signature. I've been told I cannot notarize a NY legal document, which often is an inconvenience where our partners have to travel to NY just to have an affidavit notarized. Is this true? I recently was told that I am allowed to notarize a NY legal document only IF I can get a local attorney to also notarize the document. How can we resolve this issue?

I am a NV resident currently living in Mexico. I am selling my land that is in Nicaragua and I need to give my Nicaraguan lawyer power of attorney to sell my land. The POA must be notorized and Apostilled. Can I get the POA form notorized and Apostilled in Arizona or would I be required to go to Nevada? I have a RI poa signed by an attorney notary dated 2003. The ri statute required two witnesses OR a notary. This is a legal ri poa. I am selling a Florida property and using the ri poa authority. Florida statute of 2011 notary. Requires two witnesses and a notary. My position is that a ri poa legal in fl in 2003 is grandfathered and follows pre 2011 fl legislation.

Yes, you may notarize a signature on documents prepared in another state, provided the type of notarization being requested is permitted in California, and the notarization meets all requirements of California law. In order for a California Notary to accept a driver's license from another state as proof of a signer's identity, the license must be current or issued within the past 5 years and include an identifying number and the photograph, signature and physical description of the bearer.

Hello. The signer would have to appear in person before the Notary in Florida and the notarization would have to meet all requirements of FL Notary law. You would need to speak with an attorney or the agency that will receive the documents to find out whether or not the receiving agency in Alabama would have an issue with a FL notarization on the documents.

Referring to my question above. Scenario: I'm a CA notary. The signer is DEFINITELY requesting an ACKNOWLEDGEMENT for an OUT-OF- STATE notarial certificate that WILL BE FILED out of state with the wording subscribed and sworn (Sometimes the certificate is titled acknowledgement or acknowledged before a notary) . Based on CA new notarial certificate wording, can I notarize the certificate as a acknowledgement with the other state's preprinted wording, as long as I'm not certifying the signer's representative capacity? You first need to ask the signer to clarify what type of notarization they want, since the person is asking for an acknowledgment, but the wording "subscribed and sworn" indicates a jurat certificate, based on your description. If the signer is requesting a jurat, you will need to attach and complete the California jurat certficate wording for the notarization. California Notaries must always use the CA statutory jurat certificate wording when performing a jurat. If the signer wishes you to perform an acknowledgment, you would need to attach and complete the appropriate wording for an acknowledgment, since the pre-printed wording on the document indicates a jurat, based on your description. Thank you for your response. Much appreciated. I checked 5 GCA 33450 and the language between CA and GU is "substantially" the same except for the perjury clause (ours doesn't have it). The signer does not want to ask the receiving agency if they will accept either an attached Guam certificate or remove the perjury clause. I just believe that I should not notarize something that subjects me to a perjury law in a state where I am not commissioned in. Was I right in my conservative interpretation or should I have notarized it even with the perjury clause?

Hello. I am a commissioned notary in the Territory of Guam. A friend who is currently a resident of Guam has asked me to notarize escrow documents for a property she is purchasing in CA. The language is in the form of an Acknowledgement and it is essentially the same as Guam's but for the last sentence "I certify under penalty of perjury under the laws of the State of California that the foregoing paragraph is true and correct" Our acknowledgement language in Guam does not contain the sentence and I believe I as a Guam notary is not subject to the laws of CA. Am I right to not do the notarization with the perjury language present or am I being overly conservative?

Hello. Guam Notary law says a Notary must use a certificate “A notary shall use a certificate that is "substantially" like Guam certificate wording (5 GCA 33450). We would recommend contacting the Guam Attorney General's office at 1-671-475-3324 to ask them if the CA wording is substantially similar enough for you to complete. If not, you should ask the signer to contact the receiving agency and find out if they will accept you completing and attaching Guam certificate wording in place of the CA wording.

Hello. You would need to contact the state motor vehicle department in North Carolina to ask for instructions regarding notarizing the car title. While you could have your signature notarized by a Colorado Notary, you cannot have the receiver's signature notarized without the receiver present or before the receiver has signed the document. The receiver would have to appear in person before a Notary.

CA certificates lack the wording of WA certificates and I am being told to complete the CA certificate (in WA) since it will be recorded in CA. I think this is wrong.

The notarization must take place within the borders of Kentucky unless the following two conditions are met: 1. The document will be recorded in Kentucky and 2. Residents of states bordering Illinois may be commissioned as Illinois Notaries for a one-year term if they have had a place of work or business in the state for at least 30 days preceding their application, but only if the laws of the bordering state in which they reside permit Illinois residents to become Notaries in that state (5 ILCS 312/2-101). Missouri is one of the states that permits you to become a Notary in Illinois. Nonresident applicants must use a special nonresident application, and the Notary bond submitted with the application must be for one year, coinciding with the nonresident’s one-year term of office.

Hello.You should not notarize the document if you are named in the document as a party or would receive a financial or other benefit from the document. Vermont Notaries may only use their commissions within the borders of the state except in the case of acknowledgments for deeds and other conveyances, and powers of attorney for the conveyance of lands to be recorded in Vermont.

Ok my question that I need clarification is if I'm a notary in the state of Texas and my sister needs something notarized but she lives in Florida. Can I notarize for her as long as I am in the state of Texas since I obviously know her and her signature?

Hello. In order to notarize your sister's signature, she would need to physically appear in person before you in Texas with the signed document. You cannot notarize without personal appearance based solely on your familiarity with a person's signature.

However, that does not guarantee that the probate court will accept the document. At closing on a mortgage, the closing official said the Acknowledgment on the Deed of Trust need not be notarized. Closing was in Virginia on a Virginia house. He took the Deed of Trust to a Maryland notary, who: 1. Initialed instead of signed. 2. Didn't have me sign in his presence. 3. Didn't have me sign his Fair Register (a Maryland requirement). 4. Didn't have a lending official swear an oath or affirmation as part of the Acknowledgment (a Maryland requirement). 5. Didn't have a lending official sign the Fair Register. 6. Didn't write in the correct expiration date of his commission. 7. Apparently altered the certificate of notarization. (A) If closing were in Maryland -- and it was NOT -- wouldn't all the Maryland requirements have to be met? (B) Is there any state in which a notary can initial instead of signing his name as it appears his commission and in his seal? I ask this, because land records is not supposed to record a Deed of Trust that is unlawful on its face. (C) Aren't all of 1-6 unlawful? Is # 7 unlawful, if the notary made the alterations? However, regarding your questions regarding a Maryland Notary's duties, the MD Secretary of State's website (http://sos.maryland.gov/Notary/Pages/Duties.aspx) says the following: "A notary must include on each document the notary’s printed name, signature, date of notarization, and expiration date of his or her commission. In addition, the notary must affix his or her notary seal or stamp to the document." Also, the MD Handbook for Notaries Public, page 13, states "The person making the acknowledgment must personally appear before the notary public." I bought some property from my ex. I made a bill of sale but didn't know it needed to be notorized. She lives in another state and had to drive just to get her to sign it. Hello Bailey. You cannot use certificate wording that includes incorrect information. Also, you would not be able to use the pre-printed NJ certificate wording on the document unless it exactly matches the required CA certificate language. The simplest solution would be to attach and complete a separate notarial certificate that includes the CA statutory wording instead.

For notaries in California, I was told that if the certificate contains wrong Venue information such as state and county I am able to cross it out and write in the correct venue information. Is it a CALIFORNIA NOTARY LAW that we INITIAL and DATE it next to the correction of the venue information? Can we just leave it blank, or do we have to initial it or do we have to intitial AND date?

Hello. Initialing and dating a correction in certificate wording is not specifically required under California law-it is accepted standard of care to ensure the Notary is the one who made the change. However, California law does prohibit using an incomplete certificate (GC 8205[a][2]), so you could not leave the venue "blank." Also, a Notary may not knowingly include false information in an acknowledgment certificate (GC 6203 [a]), so if the Notary was aware that incorrect information was included in a certificate, the Notary would either have to correct the erroneous information or substitute a certificate with the correct notarial wording and information.

I've a Texas vehicle gift transfer form needing notary signature, but I live in CA. CA notary didn't sign the actual TX form, but signed a separate attachment with the notary stamp on it and told me to send the attachment along side the TX form. I contacted TX tax assessor office, and they said the form is not accepted unless the stamp and signature is on their form. CA notary (I went to 3 of them) said that CA stamp is bigger size than the space available in the TX form and it will be on top of the written words and lines in the form which would make the stamp void. TX assessor office said that I need to get someone with a smaller stamp (their form only has a space of about 1 inch width and length) which I am convinced now that it doesn't exist in CA. Help! Anyone with experience with TX tax assessor office to know if they can or can't accept the attachment from CA notary as valid notarized signature?

Hello. A South Carolina Notary cannot notarize documents outside of the state's borders. However, if a signer asks you to notarize documents prepared in another state, you may do so provided the notarization takes place in South Carolina and the notarial act requested meets all requirements of SC law. To apply for a Georgia Notary commission, you would have to have regular employment or a business in the Georgia county you wish to apply for a commission in. (OCGA 45-17-2)

Clients had a deed notarized at a UPS store. They sent it to me to have it recorded in Sonoma County, California. The pre-printed Deed form had an old notary acknowledgment on it. It does not contain the language in the box (changed as of 1/1/15). The notary in Sonoma used the acknowledgment, instead of attaching a correct loose form. Sonoma will not accept it for recording. I called the UPS store and they said they use whatever form is provided to them since it could be that this document would be sent out of state for recording and would not require it to be the current California form. So my question is can the notary provide a new acknowledgment on the correct form since she has already journaled this and the signer has already appeared before her, etc.? Thank you.

In the 2016 California "Notary News" newsletter, page 5, the Secretary of State clarified: "There are no provisions in the law that allow for the correction of a completed notarial act. If you discover an error in a notarial act after completing the act, then the signature on the document must be notarized again." http://notary.cdn.sos.ca.gov/forms/notary-newsletter-2016.pdf So if a notarization was completed with an incorrect notarial certificate, the signature on the document would have to be notarized a second time with the proper notarial certificate wording in order to remedy the issue. The signer would have to appear before the Notary a second time with the signed document, be identified and follow all other required steps for the new notarization.

The Indiana Notary Public Guide states the following: "“Also, it would be wrong for a notary to authenticate (sic) the will of a relative if the notary might inherit property – even if the notary is not specifically named." Hello. The "venue" is the part of the notarial certificate wording that indicates where a notarization takes place. If we understand you correctly, you are saying that your paperwork has an incorrect Florida venue location printed in the certificate wording? An incorrect venue does not require you to travel out of state to that location to have the document notarized. When you go to a local Notary, the Notary can either line through the incorrect venue information and write in the correct venue location when performing the notarization, or alternately complete and use a new notarial certificate with the correct venue information and attach it to the document instead.

I have an applicant declaration/signature and notary to sign. I am a notary in Florida and the document that I need to sign is going to California and was made in California. On the document it says " State of California". Is there a way I am able to correct the state to say Florida or what needs to be done?

I was sent a film option and purchase agreement, and I notarized it and signed my own part. But the second party did not sign his own part, instead, he kept it for three years of the first option period . When I was apprehensive of what was happening through a lawyer, the lawyer said the producer did not sign his own copy, therefore we do not have a contract. Please should I sue this Hollywood producer for hiding and not processing a notarized and signed document from California when he received it, or it is not necessary for him to complete the process from his own end, and notarization is just not a process.

I am selling a timeshare that still has my ex on the title. The buyer states that Hawaii (where the timeshare is located) won't take a jurat. The Notary in California wrote "see attached" in the notary spot and attached the California all purpose acknowledgement. The buyer is claiming this a jurat and that hawaii won't accept it. Hi I really need help... I am refinancing my car..long story short.. My neighbor moved to mexico I live in California.. And he gave me his car and I took after the payments .he left last minute so we didn't have to to change my name to the car.. A yr later somethings is going on with my payments but I called and they won't give me any info because my names not in the car.. So now where trying to remove his name n add mine and still make the car payments.. I went to my bank because I have to refinance my car first and I had to send him papers for him to sign( those papers have nothing to do with my I don't need my signature or anything. Its for him to sign his removing his name off the car) but the notary in Mexico isn't allowing him to do that because they said I have to be present. That kinds doesn't make sence to me because those papers are between him and the bank I have nothing to do with it.. What can we do? Are they being jerks to us and giving us a hard time to get it notarized? Or I really have to be there even tho I don't need a signature on those papers..or is there something Als we can do?? Please help I'm stressing over this and just want to cry. Can we get this done? Thank you. I would really appreciate getting back to me

You may notarize a document for an out-of-state signer, provided the signer personally appears before you within the borders of Pennsylvania for the notarization and the notarial act meets all requirements of your state's laws. Be aware that Notaries must proceed carefully when asked to notarize a will, which can be invalidated by the slightest variance from strict statutory rules. A will should never be notarized if the testator is asking the Notary questions about how to proceed. Rather, the testator should be following authoritative legal instructions and a certificate or certificates must be provided for the Notary to complete. Notaries must never offer advice on how to execute a will, because they could be held liable for a named beneficiary's failure to inherit assets if the will is improperly done and therefore invalidated.

Regarding the use of out-of-state acknowledgment certificates by California Notaries, CC 1189[c] states: “On documents to be filed in another state or jurisdiction of the United States, a California notary public may complete any acknowledgment form as may be required in that other state or jurisdiction on a document, provided the form does not require the notary to determine or certify that the signer holds a particular representative capacity or to make other determinations and certifications not allowed by California law.” Please note that a California Notary must still follow all CA notarial laws if completing an out-of-state acknowledgment form as described above. For example, a signer must still present satisfactory evidence of identity that meets CA statutory requirements in order to have his or her signature notarized.

For an acknowledgment, the signer must personally appear before the Notary, present satisfactory evidence of identity and acknowledge that he or she is the person who made the signature. The jurat, which is a different notarial act, requires the signer to write his or her signature on the document in the Notary's presence and then swear or affirm the truthfulness of the signed statement.

I live in California, and transact with realty in other states, eg North Carolina. You have answered the question of a notary in California using the out-of-state acknowledgements pre-printed on many real estate forms -- they must comply with CC 1189(c). Now that it's 2015 and the new "consumer warning words" are the law of the land with respect to California notary acknowledgements, is your advice to folks you gave in Nov 2014 (see elsewhere on this forum page) still valid? Or is it now the case that any out-of-state notary acknowledgement wordings preprinted on forms are not OK for California notaries to use, because they will of course lack this wording, and thus requiring a loose sheet. I have to comment, also, that California is the worst nanny state I've ever seen by requiring this kind of garbage; if you are having something notarized, or have a notarized document, and you're not sure what it means, shouldn't you be talking to an attorney? DOH!

Hi, I am a Notary Public in the state of Massachusetts. I also work for a bank in Massachusetts. Myself and my coworkers often notarize real estate documents. I know that Massachusetts prohibits nonattorney notaries to conduct real estate closings unless it's for your own bank's closing but it does that mean we can not notarize the closing documents for other state closings as well? Example: Massachusetts resident asking Massachusetts notary to notarize closing documents for a Georgia property purchase. Thanks

Notaries are ministerial officers, which means that the law prohibits nonattorney Notaries from giving advice to signers regarding the preparation of a document--including who is required to sign the document or who requires their signatures notarized on a document. As a Michigan Notary, if someone asks you to perform a notarization, you may certainly do so as long as the notarial act takes place within the state's borders and meets all requirements of state law. But you cannot advise the signer whether or not her brother needs his signature notarized. If the signer has questions regarding preparation of the document, she needs to contact an attorney or another qualified professional authorized to advise her on how to prepare the document.

I have a document from the State of Virginia that I have been unable to get notarized in California. The wording on the document is: "Sworn to before me and subscribed in my presence this ___ day or ___" The California notaries I have talked to said this is "jurat" language, not "acknowledgement" language, and therefore under California law they cannot notarize this as written. Every notary I have spoken to insists on attaching a separate certificate with California language. (Apparently "acknowledgement" language would be OK.) I sent such a notarized document to Virginia, and they sent it back, saying "Virginia requires the notarization to be on the same page as the signature." Note that this is the Commonwealth of Virginia itself I am dealing with, not some local whoever. So, as far as I can tell, it is impossible for me to have this Virginia state document notarized in California. Is this correct?

Hello. Your message doesn't specify whether the notarization you are requesting requires an acknowledgment (where the signer is identified by the Notary and acknowledges he or she signed the document) or a jurat (where the signer would write their signature in the Notary's presence and then swear or affirm before the Notary the truthfulness of the document.) California Notaries are required to use the specific certificate wording dictated by CA state law when performing a jurat. The notarial wording for acknowledgments and jurats is not interchangeable. Before proceeding further you should confirm with the agency receiving the document exactly what type of notarization is required, and any other requirements the receiving agency wants.

You may notarize the signature of a person from another state, provided the person whose signature is being notarized appears before you in person within the boundaries of North Carolina, presents satisfactory proof of identity and the notarial act meets all other requirements under North Carolina law. Also, you must not be a named party in the document, a signer of the document or receive a benefit from the document other than any notarial fee paid to you.

Hi, I am in the State of Connecticut, I was frauded out of real property in the State of California by a Connecticut resident. Two Connecticut notaries on separate occasions authenticated the fraudsters signature on a Deed of Trust, the date they allege they performed their duty is different then the day the document was signed by the fraudster. The notaries did not cross out the venue on the pre-printed document which reads that they Swear Under the Laws of California, neither notary holds a CA license only licensed in CT. Both of these notarizations were actually notarized on a completely different day then the documents in question were supposedly signed by the fraudster. One notary stuck a notarization on a separate sheet of paper with no mention of what he was notarizing, the date he puts his notarization being a month or so later then when the fraudster signed, no additional authorization was added. The other notary actually stamped the document but the date was different then the supposed date the fraudster signed, she also swears to the laws of California, but only has a Connecticut Notary license. I would also like to mention that I have the opinion of the Superior Court Judge that I am credible to the fraud of my property and am desperate to Void these documents to quiet title, but the corruption in Connecticut is unconcionable and before I move forward I would like to be advised as to where to report notary fraud if the Secy of State Notary Division has apparently made the decision to further the fraud by turning a blind eye to what their licensed notaries have done. I would sincerely appreciate your assistance with this matter as it is time sensitive and I am acting pro se, Thank You.

Hello, Unfortunately, we can only comment on questions related to state Notary law. There is nothing that would prohibit a person from traveling to Texas and requesting their signature be notarized on a document there. However, we cannot answer whether a particular document would be valid for your transaction or not. You would need to consult with an attorney or other professional qualified to answer that question to determine the document's acceptability.

Hello, A California Notary could notarize a signature on a document being sent to Kentucky. The signer would have to personally appear before the Notary in California, present satisfactory evidence of identity and meet all requirements of CA Notary law. It's not clear from your question if you are named in the documents you are describing. Please remember that a CA Notary may not notarize a document in which the Notary has a direct financial or beneficial interest, such as being named in the document or a party to the document's transaction.

The venue I know to correct. My confusion is with "under penalty of perjury under the laws of the State of California". I would think it would be appropriate to change California to Minnesota in this case, as that is where the acknowledgment is taken, and so is bound under the laws of that state, and not the state where the document originated from. Am I wrong, in this case, and I am bound under the state of California, a state I have never set foot in. I hope that clearly explains my question.

Hello Michael, The Minnsota Secretary of State's office does not address this specific issue on their website. Regarding out-of-state certificates, they have posted the following: Can I notarize a document that was created in another state? Yes. The portion of the notarial certificate that says "State of _________, County of _________" is called the venue and reflects where the notarization occurs regardless where the document originated. Put in your state and the county where you are performing the notarial act. If it's not clear whether out-of-state certificate wording meets or conflicts with the requirements of Minnesota Notary law, we recommend instead attaching and completing a loose certificate using the appropriate short form wording provided in MS 358.48 for the notarial act requested instead. Okay, so what about notarizing a document from CA (Deed of Trust), but I am in Minnesota? I corrected the venue, but I also corrected the "under Penalty of Perjury under the laws of the State of California" verbiage and put Minnesota instead. I am now being told this is wrong, and I need to correct it. Am I not governed under the laws of the state where acknowledgement takes place?

Hi Michael. No matter what state you are commissioned in, the venue on the notarial certificate indicates where the notarization actually takes place. So if you are commissioned and performing a notarial act in the state of Minnesota, the state indicated in the venue should be "Minnesota." I hope this information is helpful.

Now I'm confused too. I'm a California notary and just recently I did loan docs from Florida and I was told that with the Jurats that you must have a California loose certificate. Also, the section of the Florida loan docs that required acknowledgments didn't have the penalty of perjury statement so I did all loose cert attachments.... I hope they wont kick it back because of that.

Hello Penny, CC 1189[c] specifically refers to acknowledgment certificates on documents to be filed in a state or jurisdiction outside California. You are correct that when executing jurats, California Notaries are required to use the statutory CA jurat wording exactly as prescribed in statute. Unlike many other states, CA Notaries are required by law to certify when executing a jurat that the signer was identified by the Notary through satisfactory evidence--which is why in the situation you described you would need to still use the CA jurat wording, because identifying the signer is not part of the jurat requirements or wording in Florida.

I was told the same thing by someone on the Notary Hotline. I am in California, and I often have to notarize out of state title documents for vehicles and retirement documents that are filed in Texas. I was told that if the document(s ) were to be filed outside of California, I did not need to have a certificate. If I am supposed to be attaching a notorial document to these and have not, nothing has been acted on (so far) and I have had no claims against me. To hear that I might have received bad advice us concerning.

Hello Jeremy, Some form of notarial wording, either pre-printed on the document or on an attached loose certificate, is needed when notarizing a signature on a document. Regarding the use of out-of-state acknowledgment certificates by California Notaries, CC 1189[c] states: “On documents to be filed in another state or jurisdiction of the United States, a California notary public may complete any acknowledgment form as may be required in that other state or jurisdiction on a document, provided the form does not require the notary to determine or certify that the signer holds a particular representative capacity or to make other determinations and certifications not allowed by California law.” If the documents you referenced were filed out of state but had pre-printed notarial wording that met the criteria above, it would be OK to use that pre-printed notarial wording on the document without attaching a loose certificate. However, it is not permitted to simply "stamp and sign" a document that lacks any certificate wording.

Hello Alberta, Anyone whose signature on the document is to be notarized must personally appear before you and be identified according to your state's laws. So if the person making the notarization request wishes his signature on the document notarized, he must appear in your presence, and if the sister's signature needs to be notarized, she will need to appear in person before you.
