Summary

House Bill 1889 defines “notarial act” for the purpose of recognizing notarial acts performed outside Virginia by notarial officers of other states, of the foreign service of the United States, and of the armed forces of the United States.

Analysis

House Bill 1899 is a relatively straightforward bill. It simply defines “notarial act” for the purpose of recognizing notarial acts originating outside and used within the Commonwealth. Yet, the bill has some important ramifications. The first is that a notarial act performed by a notarial officer outside Virgnia is one that a Virginia Notary may perform. The other is that both tangible (paper) and electronic notarial acts (including those using in-person electronic notarization and remote online notarization) may be recognized.
