AZ Senate Bill 1486 - Senate Bill 1486 makes a technical change allowing all Notaries who change their surnames to continue to notarize using the old name until commission expiration. Formerly, this was only allowed for name changes due to marriage.

NC House Bill 545 - House Bill 545 recognizes the legal status of electronic notarizations performed by any Virginia Notary that are recorded in the register of deeds office of Mecklenburg County, North Carolina, even though such eNotarizations have been temporarily postponed in Virginia until the General Assembly publishes rules; cures certain defective notarizations; states the needed conditions for recording electronic land title documents; and clarifies that typographical errors in a recorded document may be corrected by recording a “scrivener’s” affidavit.

LA House Bill 781 - House Bill 781 primarily defines prohibited acts related to the unlawful exercise of notarial powers and provides penalties, outlines the complaint process and clarifies that licensed attorneys who are Notaries are still subject to oversight by the state Supreme Court.

VA House Bill 218 - House Bill 218 is “clean-up” legislation for last year’s comprehensive Notary and electronic notarization laws. HB 218 removes the requirement for endorsements on an application to become a Notary or electronic Notary; removes the provision that a failure to affix a seal on a paper or electronic document shall not affect the legality or efficacy of the document; specifies notarial officers outside of Virginia who can notarize documents for use in Virginia; clarifies that an improperly notarized document shall not invalidate the underlying document even if it is not in proper form for recordation; requires Notaries performing electronic notarization to keep the required electronic journal for a period of five years from the date of the transaction and adds a new misconduct provision.

SD House Bill 1030 - House Bill 1030 permits any resident of a county bordering South Dakota who has a place of work or employment in South Dakota to become a Notary and streamlines the statute providing the requirements for the Notary’s official seal.

LegislationJul 01, 2008 - Wyoming
WY House Bill 36 - House Bill 36 enacts the Uniform Law on Notarial Acts, a model notarial law promulgated by the National Conference of Commissioners on Uniform State Laws in 1982, and repeals the former Wyoming Acknowledgment Act and several other statutes governing the acceptance of acknowledgments performed by notarial officers of other U.S. states and jurisdictions.

UT House Bill 26 - House Bill 26 changes the definition of “satisfactory evidence of identity” by adding clarifications on the written forms of ID a Notary may accept and disqualifying certain IDs which do not properly constitute satisfactory evidence. House Bill 26 also revises the required elements which must appear on the Notary’s official seal, and the elements from the seal which must be added to a plat map or electronic acknowledgment notarized without affixation of an image of the seal. Finally, House Bill 26 also makes changes in procedures for a Notary reporting an address and name change.

UT Senate Bill 114 - Senate Bill 114 provides exceptions to the statute prohibiting a Notary from notarizing when the Notary is a signer or named in a self-proving will or a licensed attorney who is representing a signer or another person named in a document.

GA House Bill 1055 (2008) - House Bill 1055 provides for the licensure of “immigration specialists” — non-attorneys who provide non-legal and ministerial immigration-related services, defines the duties and ethical conduct of immigration specialists, and authorizes the Secretary of State to investigate and enforce the provisions of the chapter. Certain activities of Notaries are directly affected by the new law.

TN Senate Bill 3195 - Senate Bill 3195 adjusts certain fees that county clerks may charge Notaries, among many other fee adjustments for county clerks.
