IN House Bill 1350 - Indiana enacts the Uniform Unsworn Foreign Declarations Act (UUFDA). The UUFDA permits a person living or traveling outside of the U.S. who must sign a sworn statement to make the statement under penalty of perjury without having to appear before a Notary or U.S. consular officer to take an oath or affirmation.

DE House Bill 455 - House Bill 455 enacts the Durable Personal Powers of Attorney Act, requiring a durable personal power of attorney to be signed by the principal, or by another person at the direction of the principal and in the principal's conscious presence, witnessed by one witness not related to the principal by blood or marriage or who is not entitled to a portion of the principal’s estate and acknowledged before a notarial officer.

DC Administrative Rules (2010) - New administrative rules became effective this fall include an increase in the commissioning fees from $50 to $75, an increase in fees charged by the Office of Commissions and Authentications for certifications and Apostilles from $10 to $15 per document, and changes in rules pertaining to the official embosser used by Notaries to authenticate a notarial act.

WI Assembly Bill 704 - Wisconsin enacts the Uniform Power of Attorney Act (UPOAA). If a power of attorney is presented for notarization, a Notary will need to know that a signer may sign the power of attorney or may direct another person to sign it for him or her. The Act doesn’t require a power of attorney to be notarized, but a court will presume the signature to be genuine if it is acknowledged before a Notary or an officer authorized to take acknowledgments.

LA House Bill 357 - House Bill 357 designates any non-resident individual licensed to practice law in Louisiana as an ex officio Notary Public, authorizes such individual to perform notarial acts in any parish in which he or she maintains an office to practice law and requires such individual to post the bond or insurance required under R.S. 35:71.

MN House File 910 - House File 910 adjusts the commissioning procedures for both resident and nonresident Notary commission applicants; clarifies that all Notaries and ex officio notarial officers must obtain and use an official notarial stamp; and permits a principal with a physical limitation that prevents the principal from signing or making a mark to direct another person to sign or affix his or her signature, mark or name.

MN House File 3187 - House File 3187 permits any oath or affirmation subject to Minnesota’s Notary statutes in MS 358.07-358.09 to be taken under penalty of perjury without notarization in a matter involving a civil commitment. The new law also permits electronic documents with electronic signatures to be filed in matters related to civil commitments provided that security mechanisms that mirror the mechanisms the NNA has long advocated for electronic notarizations are instituted.

AZ House Bill 2037 - House Bill 2037 permits the Secretary of State to require that all applicants for a regular Notary commission take an educational course. The bill specifies 4 types of written identification document a Notary and Electronic Notary may accept as satisfactory evidence of identity for notarial acts in general and 2 additional types they may accept for real property conveyances and finance transactions in particular. HB 2037 also repeals provisions requiring Notaries to affix their commission expiration dates on each notarial certificate and permitting Electronic Notaries to issue a “Notary service electronic certificate” to a signer for the purpose of performing electronic notarial acts in the Electronic Notary’s name without the Electronic Notary present. The bill also requires an Electronic Notary to be a U.S. citizen or legal permanent resident.
