Summary

House Bill 334 authorizes an adult with a disability to enter into a supported decision-making agreement that must be signed by two witnesses or a Notary Public. 

Affects

Adds Sections 75-5-701 through 75-5-709 to the Utah Code Annotated.

Changes
  1. Defines supported decision-making as the process of supporting and accommodating an individual in the decision-making process to make, communicate, and effectuate life decisions, without impeding the self-determination of the individual.

  2. Authorizes an adult with a disability to enter into a supported decision-making agreement.

  3. Requires a supported decision-making agreement to be in writing.  

  4. Specifies the information that must be included in a supported decision-making agreement.

  5. Requires a supported decision-making agreement to include the ink or electronic signature of the individual entering into the agreement, each supporter, a guardian, conservator, or qualifying person if required, and either two witnesses or a Notary Public.  

Analysis

A supported decision-making agreement is an important alternative to legal guardianship that allows an individual with a disability to maintain autonomy while designating one or more supporters to help the individual make certain important life decisions. House Bill 334 permits certain individuals to enter into a supported decision-making agreement and requires either two witnesses or a Notary Public to sign the agreement.
