Summary

House Bill 1992 effectively enables Notaries Public to set their own fees.

Changes
  1. Strikes the maximum fee of $10 that a Notary may charge for each instrument notarized and clarifies that a Notary may charge a fee for each instrument notarized.
Analysis

Instead of giving Notaries a pay raise by raising the maximum fee they may charge for a notarial act, the South Dakota Legislature may have done even better: It removed the statutory $10 maximum fee so that the statute now says, “A notary public may charge and receive a fee for each instrument notarized, except that no notary public may charge a fee for notarizing a request for an absentee ballot.” The effect of the amendment is to allow Notaries to set their own fees.
