Summary
The New Jersey State Treasurer adopts permanent Notary education and examination rules.
Affects
Adds Sections 2.1, 2.2, and 2.3 to Title 17, Chapter 50, new Subchapter 2 of New Jersey Administrative Code.
Changes

Course and Exam for Initial Notary Commission

  1. Requires a non-attorney applicant for an initial commission as a Notary Public to complete a course of study that fosters the applicant’s understanding of the statutes, rules, procedures, and ethical requirements documented in the State of New Jersey Notary Manual at www.nj.gov/njbgs.  
  2. Clarifies that the State Treasurer shall ensure that the online course can be accessed through www.nj.gov/njbgs.
  3. Requires a non-attorney applicant for an initial Notary Public commission to pass an online test at www.nj.gov/njbgs that confirms the applicant’s understanding of the course content required by NJAC 17:50-2.2(a) before being granted the initial Notary commission.
  4. Clarifies that the State Treasurer shall ensure the online test and test instructions are accessible at www.nj.gov/njbgs and that the testing process is integrated with New Jersey’s online Notary Public commissioning system.
  5. Provides that the online system shall generate certificates of approval evidencing that applicants have passed the test, record that applicants have passed the test, and clear applicants to submit their notary public commission applications.
  6. Authorizes the State Treasurer to charge up to $15 for administering each examination.

Continuing Education for Renewal Notary Commission

  1. Requires a non-attorney applicant for renewal of a Notary commission who has previously completed the educational and testing requirements at least one time, or who was commissioned for the first time before July 22, 2021, to complete a continuing education course. (Note: In a public announcement on June 21, 2022, the Treasury Department clarified the date of July 22, 2021 was changed to October 22, 2021.)
  2. Provides that the continuing education course shall focus on the statutes, rules, procedures, and ethical requirements documented in the State of New Jersey Notary Manual at www.nj.gov/njbgs.  
  3. Clarifies that the State Treasurer shall ensure that the online continuing education course can be accessed at www.nj.gov/njbgs.
  4. Requires the State Treasurer to ensure the online continuing education course is integrated with the State's online Notary Public commissioning system.
  5. The online system shall provide certificates of approval evidencing that applicants have completed the continuing education course, record that applicants have completed the course, and clear applicants to submit their Notary Public renewal commission applications.
Analysis

Last fall, the New Jersey State Treasurer, the commissioning official for New Jersey Notaries Public, published for comment proposed Notary Public education and examination rules. After the conclusion of the public comment period, the State Treasurer has adopted these rules as proposed.
