SummaryThe North Carolina General Assembly overrode a Governor’s veto of a bill that, among other things, validates video notarizations performed from July 1, 2024-September 8, 2024.
AnalysisDuring the COVID-19 pandemic North Carolina was one of the states that authorized temporary remote notarial acts to be performed.
On September 9, 2024, the General Assembly overrode the Governor's veto of House Bill 556 that extended these temporary remote notarization and witnessing provisions until July 1, 2025. Since House Bill 556 didn’t take effect until September 9, 2024, and the prior extension of the law authorizing these remote notarizations and witnessings expired on July 1, 2024, the General Assembly wanted to validate any emergency remote notarial acts and witnessings that were performed in the interim period when the law technically was not in effect. This is what Senate Bill 382 does.
Like House Bill 556, Senate Bill 382 was vetoed by the Governor. Senate Bill 382 started as a measure dealing with dentistry laws before being “gutted and amended” into a disaster recovery bill that included the remote notarization and witnessing validation provisions, among others. After passage by the General Assembly, the Governor vetoed the bill, and the General Assembly subsequently overrode the Governor’s veto.
