Analysis

In response to the COVID-19 pandemic, we are seeing governors of states take action to extend driver's licenses and other IDs. Georgia Governor Kemp just issued Executive Order 03.25.20.01 related to Georgia driver's licenses and state identification cards. For Georgia Notaries, in particular, this executive order is important. OCGA 45-17-8(e) states, "In performing a notarial act, a notary public shall confirm the identity of the document signer, oath taker, or affirmant based on personal knowledge or satisfactory evidence." While "satisfactory evidence" is not specified or defined in Georgia statute, the standard of professional practice for Notaries operating under a law like this would be to accept a valid, unexpired credential issued by a government office or agency with at least a photograph and signature. Since the validity of the ID is very important, an act such as the Governor's in this Executive Order directly affects any Georgia driver's license or identification card presented to a Notary.
