Summary

Assembly Bill 2337 authorizes the use of electronic signatures on certain workers’ compensation documents.

Affects

Adds Sections 110.5 and 3206.5 to the Labor Code.

Changes
  1. Provides that for purposes of the workers’ compensation system, documents that require a signature, including a Notary’s signature on an acknowledgment, may be signed with an “electronic signature.”
  2. Defines “electronic signature” as an electronic sound, symbol, or process attached to or logically associated with an electronic record and executed or adopted by a person with the intent to sign the electronic record, where the electronic signature is attributable to a person consistent with the requirements of the Uniform Electronic Transactions Act (Civil Code  Sections 1633.2(h) and 1633.9(a) of the Civil Code) or Government Code Section 16.5.
Analysis

The Workers’ Compensation Appeals Board (WCAB) temporarily allowed the use of electronic signatures in workers’ compensation proceedings during the COVID-19 pandemic. WCAB rescinded this authorization and resumed the requirement for wet ink signatures when the Governor declared an end to the state of emergency, as electronic signatures were not explicitly authorized under the Labor Code. Assembly Bill 2337 remedies this by amending the Labor Code to allow the use of electronic signatures in documents and filings in proceedings before the WCAB.
