Summary

Senate Bill 8 waives the requirement that the renewal application of a Notary or Electronic Notary must be sworn before an officer authorized to administer oaths under certain conditions, as specified. 

Affects

Amends Section 47.1-5.1 of the Code of Virginia.

Changes
  1. No longer requires a person applying for recommission as a Notary or Electronic Notary to include the oath of the applicant required by COV 47.1-5 if the applicant is in good standing, is not subject to any investigation or proceeding, or has never been removed from office.
  2. Makes technical changes.
Analysis

Under existing law, all applicants for a Notary or Electronic Notary commission must have their application notarized prior to submitting to the Secretary of State. Senate Bill 8 waives the requirement for renewal applicants provided the applicant is in good standing as a Notary or Electronic Notary at the time of application, is not subject to any investigation or legal proceeding, or has never been removed from office as a Notary.
