Summary

Assembly Bill 1784 permits certain candidates for office to withdraw their candidacy by executing a statement of withdrawal before a Notary Public if the candidate does not execute it in the office of the elections official.  

Affects

Adds new section 8020.5 to the Elections Code. 

Changes
  1. Provides that a candidate may withdraw nomination documents for any office other than a statewide office (see definition below) by executing a statement of withdrawal either in the office of the elections official or in the presence of a Notary Public appointed by the Secretary of State or other state official.

  2. Defines "statewide office" as the office of Governor, Lieutenant Governor, Attorney General, Controller, Insurance Commissioner, Secretary of State, Superintendent of Public Instruction, Treasurer, or Member of the United States Senate. 

Analysis

Assembly Bill 1784 was enacted in response to a 2024 California appellate court ruling, which held that state law did not prevent a candidate from running for the U.S. Congress and the California state Assembly at the same time The law clarifies that a person cannot file nomination papers for more than one office at the same primary election and creates a process to allow a candidate for an office other than statewide office to withdraw their candidacy up until the primary election filing deadline. The candidate must sign a statement of withdrawal before a Notary Public if the candidate does not execute it in the office of the elections official.
