If I am notarizing a motor vehicle title, do both the seller and the buyer have to be physically present at the same time in order for me to notarize their signatures, or just the seller? — H.W., Scranton, Pennsylvania

You not need both parties to be physically present at the time of notarization, but you can only notarize for the person who is appearing before you. The other person can have their signature notarized at another time.

I know that i should not notarize his signature, but can I notarize the Seller's signature on the title (if he properly appears before me) and have my husband go to an unrelated notary to have his Buyer's signature notarized at a different time?

Hello. North Carolina prohibits notarization if the Notary will "receive directly from a transaction" a benefit or other consideration exceeding the statutory Notary fee, or if the Notary is a "beneficiary of the record that is to be notarized." (GS 10B-20[c][5] and [6]) In this situation, we recommend erring on the side of caution and having a different Notary with no involvement in the transaction notarize the signatures.

Hello. Pennsylvania does not authorize Notaries to conduct a notarization remotely with a signer remotely using a webcam or other audio/visual remote technology.

Bought a car from a guy who had his daughter notarized the title in front of me. Upon his depart I observed that the title that was just notarized was not even in his name. It was in a female's name. When questioned, He explanation was that he buys cars from people, let then owner sign the title and resell it and just have his daughter notarized the title. Is this a legal transaction since he never transfer the title in his name and I don't know or met the owner that is listed on the title?

I am buying a vehicle from a relative who lives in Chicago and I live in North Carolina. He has already sent me the title and everything else all signed but it doesn't appear to be notarized. Bought a bike in PA, I live in WV. Here we don't require notarized title, but since it's a PA title can't register the motorcycle until the title has been notarized. Now I can't get in touch with the previous owner, how do I get this notarized? I have a friend who bought a car cash in Charlotte, NC from the owner. The owner signed the title, but did not sign it before a notary. The License Plate Agency will not notarized my friend's signature because the seller did not notarize his signature. He lives 2 hours away. Is there anything my friend or the seller could do to fix this?

Hi, I am getting a title notarized in North Carolina. Here's the problem...The owner signed the title over to me, I got it notarized, and I paid the notary fee ($5). When I arrived at the DMV, the person I talked to said that I have to claim ownership of the vehicle (Didn't I already claim ownership if the title was signed over to me?), then she said I have to pay $10 for the notary fee. Why?

So I have a question. Me and my fianc� did a notary deal. It doesn’t state much other than the basics,payment date, payment amount, and full responsibility of the car. I am buying a car from my brother, he is in KY, and as far as I know the seller has to have a notary when doing his signature, not sure about this, I reside in Florida, we could have the car brought down by truck, and myself not actually have to go there, now can he alone sign the title with a notary if needed, and fill out my name and address, and me have a signature with a notary if required here in Fl.to finalize the process... Hello. I purchased a vehicle from a private owner. I was led to believe he was the owner of the vehicle. Upon trying to get a tag for vehicle, I was told by DMV Clerk that car needed an inpection and told the fees I would need to pay. I stated, I thought it already been inspected and couldn’t afford the fees on that day being I just gave my all to purchase the car. Clerk informed me the owner could obtain a temp tag and asked to bring him into office. Again, I was under impression seller was the owner. The seller of the vehicle was not the owner but he was the person who wrote in my information on the title while we sat in his car, the seller was also the person who notarized the title while sitting in his car. The seller stated to the DMV Clerk, the owner of vehicle just left the parking lot to go to work out of town for several weeks. This was a lie! The seller, which is also the notary, stated to me away from the clerk, it’s my car to sell, I just never had the title switched in my name. He also states, the owner needed money, which is why the original owner sold his vehicle. My question, being that the notary name is not on the title, did he have the legal rights to sell vehicle and notarize vehicle. The original titled name was already signed on title.

Hello. North Carolina Notaries are not automatically disqualified from notarizing for relatives. NC Notaries are disqualified from notarizing if the Notary is a signer, party or beneficiary of the document being notarized, or if the Notary would receive a benefit or payment from the document above the Notary's maximum statutory fee. (GS 10B20[c][5] and [6]). However, the Secretary of State's office recommends that Notaries not perform notarizations for relatives.

May 2017 or Nov 2017, as guy has known notory many years, and before i can use casation laws of a car title not notorised at proper signings Nov 1st 2017 the laws that changed saying both parties must appear might give me reason to say she help in causations of law... so one May 2017 would both parties need present same place same time -- Nov 2017 would both parties need present same place same time..? he is seller im the buyer--- notory knows seller long time and seller says - goto my notory as im signing them now in front of you she will understand and she will notorize thease documents and you can get your car plates today-- as i had done May 2017 and Nov 2017--- but Nov 2017 i had a trade in car and now contending court actions and becouse we were not both present at notory Nov 2017 and seeing laws changed where both parties must appear her to not follow laws may have causations that if we both been present the now open title on my trade in would have fact been notorized at same time of regerstation of new car purchased nov 2017, as if laws applied Nov 2017 where both parties must appear same place same time this seller would not have caused me harms-- so may 2017 was it ok to have seller sign then send me down- was nov 2017 ok for seller to send me down - as at no time seller apeared as notory given and licensse plates and my new titles generated-- my trade in vehicle guy conned me saying he would have her notorize later as he never did and now im liable for ticket as titles still in my name-- causation is that nov 2017 if both parties were at notory i would have notorized his title and my new title forcing an issue where no open title remained, as causation laws say she might be liable as letting this guy sing by not being present-- have ive well stated my wmquestion or is further detail needed

My daughter sold a car for parts in PA. She met the buyer at the notary and signed over the title. The notary told her they didn't need anything else from her and that she could leave. Now, a year later, she gets a letter in the mail slapping her with a fine for not paying tickets she was unaware of. She called the notary, and apparently after she left the transfer was never completed. The buyer drove off with the car and eventually abandoned it in Philadelphia. What can she do to resolve this? The notary won't give her any more information. This pperson originally contacted her on Facebook but has deleted his account. In hindsight she should have stayed to complete the transfer. Oh, and she had removed the license plate and put it in the back of the car she was driving. She had forgotten about it but now realizes that this guy must have stolen it from her car. Very shady.

Hello, i currently live in Louisiana and i have a bit of a problem. Back in October of 2017 my boyfriend got into a car wreck and because of family problems he had to move back to Austin, TX ; he is not able to come visit because of his family problems. Now that it is May 2018, i am about to move out of my apartment in June and the car that he wrecked is still sitting on my lot and I’m trying to get rid of it. A lady down the street wants to buy it. Great but, the only thing is that we need to go to the notary. His dad signed papers of “Texas Certificate it Title” and “Application got Texas Title and/or Registration, because the car is under his dad’s name. He sent the paper work to me and I’m about to head to the notary with the woman who wants the car. Will this be able to work?? I saw him sign the papers through Skype to make sure it was him signing it. Since they cannot come to Louisiana I’m trying to go to the notary for them in order to sell this car for them. Hello- Our son is military and purchased a vehicle in Kansas. Upon going to get it registered in his state of record, they informed him that the owner (before the owner that sold him the car), and failed to have his signature notarized at the time he signed the title over. The DMV had our son begin a bonded title process. He received documents back showing the owner two times back whose name is on the title, as being the last in record. We now need to send a certified letter to try to get assistance with getting the title notarized. The problem is that he is in Oklahoma over 5 hours away. How do ask for notarization of this title when they are in different states? What the options for notarization so we can state this in the certified letter? Can it be notarized with him just providing two forms of ID? Thank you for any assistance...

I purchased a moped quite a few years back it was a wreck so I picked it up for next to nothing. Well I was fixing it up as a little Hobby it's sat in the garage for years till I finally got everything done and I went to go get it registered. I live in Florida and it's a New Mexico title when the gentleman signed it he's kinda in the wrong place at first he crossed it out initialed it and then signed in the right place well when I went to get it registered they just told me there was no way to register it because it was an alteration to the title. I spoke with one gentleman I don't know who he was over the phone and he wanted pictures of the moped the title and the VIN number and he assured me he could get a title for it at the cost of $450 as far as I'm concerned that's more than the bike is worth. So many years have gone by I have no way of getting hold of the original owner is there any way with what I've got to get a title for this moped and get it registered? It's not stolen I know this for sure.

I thought we could still get it notarized by going in person and noting to the notary that we did sign the document. The UPS store said that was not the case but everywhere online shows that it should be fine. the trickiest part is that I'm in WA and my father is in MT so we would have to get it notarized separately.

A buyer and seller go into the bank to conduct the purchase of a vehicle. The seller signs the title over. In Oklahoma, the seller's is the only signature that has to be notarized. The bank representative offers to get his notary to come in the office. The buyer says "No need, I will notarize it as I am a notary." I'm the admin at a church and the pastor is donating his old car to the church so we can donate it to a needy family later. The pastor is the donor, and the church is the recipient. I live in one county and work in another county in NC. I took my title to a notary close to my place of work. She drew a line through the county I stated on the title, which is the county I live in and wrote the county in which the document was being notarized. Now the document has been rendered useless due to the line being drawn through the county I stated on the document. And now the company that wants to buy the car has literally withdrawn. Hello, I am in Missouri and work at an RV dealership. We took a recreational vehicle in on trade with an Arizona title. Did not realize the transfer between the original owner and us needed to be notarized (Missouri does not require notarizations on titles and we have never taken in an Arizona title before), and both parties have signed already. Am I able to get my signature notarized still, even though the notarization will be a different date than the actual transfer date?

Hello I have been in the process of purchasing a car from a dealership in North Carolina. I live in Virginia. The agreement was that I would pay an additional fee and the dealership would transport the car to me here in Virginia. Along with the typical sales paperwork I was given to power of attorney forms to be notarized for DMV purposes. The date I received the paperwork happen to be on a Sunday and I could not find an available notary; however, upon researching area notaries I realized that due to the pandemic virtual notaries have become popular. I researched laws in Virginia and North Carolina which both clearly stated a virtually notarized document is legal. The dealership contacted me today and stated they had never received a virtual notarized document and I would need to have it notarized again in person and send to them before they could obtain registration documents from DMV. Could someone please provide clarification on this matter? I do not feel that it’s fair that I should have to pay to have these documents notarized twice. Thanks

A notary who is an employee of a party shall not be disqualified under this subdivision solely because of the notary’s employment by a party to the record or solely because the notary owns stock in a party to the record … The notary will receive directly from a transaction connected with the notarial act any commission, fee, advantage, right, title, interest, cash, property, or other consideration exceeding in value the fees specified in G.S. 10B-31, other than fees or other consideration paid for services rendered by a licensed attorney, a licensed real estate broker or salesperson, a motor vehicle dealer, or a banker” (GS 10B-20[c][5] and [6]).

I am in NC and bought a car off of someone. He signed the title but not in front of a notary so it is not notarized. I inquired at the DMV and they drew a line threw it and wrote void across it and gave me the form for him to sign in front of a notary. Now we can not get ahold of him. Notaries in North Carolina may use either an ink stamp or embosser to perform notarizations that meets the following requirements: “The notary seal may be either circular or rectangular in shape. Upon receiving a commission or a recommission on or after October 1, 2006, a notary shall not use a circular seal that is less than 1½ inches, nor more than 2 inches in diameter. The rectangular seal shall not be over 1 inch high and 2½ inches long. The perimeter of the seal shall contain a border that is visible when impressed” (GS 10B-37[c]). A Notary’s official seal must include all of the following components (GS 10B-37[b]): Name of Notary exactly as it appears on commission; “Notary Public”; Name of county in which commissioned, including the word “County” or “Co.”; “North Carolina” or “NC”.
